OceanIR Terms of Service

Effective Date: October 13, 2025

By accessing or using OceanIR – the AI-powered geolocation platform provided by Bower Software Industries, Inc. ("Bower," the "Company," "we," or "us") – you ("User" or "you") agree to be bound by these Terms of Service (these "Terms"). These Terms constitute a legally binding agreement between you and Bower. If you do not agree to any part of these Terms, you must not access or use the Service.

By accepting these Terms, you also agree to abide by all additional guidelines, policies, or rules that we may post (such as our Privacy Policy), which are incorporated by reference. If you use the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to both you (the individual) and that entity. You affirm that you are legally competent to enter into this agreement.

1. Acceptance of Terms

By accessing or using the OceanIR website, platform, API, or any related services (collectively, the "Service"), you indicate that you have read, understood, and agree to these Terms in full. Your use of the Service constitutes acceptance of these Terms. If you do not agree, you must cease use of the Service immediately. Use of the Service is also subject to any additional posted policies or guidelines, including our Privacy Policy. In the event of any conflict between these Terms and supplemental policies, these Terms will control unless explicitly stated otherwise.

If you are using the Service on behalf of an organization or third party, you represent and warrant that you have the authority to bind that organization to these Terms. In such case, references to "you" in these Terms include both the individual user and the organization. You agree that you are at least the age of majority in your jurisdiction (or at least 13 years old with parental consent, as further described in the Age Requirement section below).

2. Use License

Subject to your strict compliance with these Terms, Bower grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the OceanIR geolocation intelligence Service for your own internal business or personal purposes. This license is provided solely for lawful use of the Service as intended by Bower and in accordance with these Terms.

Under this license, you may access, use, and interact with the Service and any content or results provided to you. No other rights are granted: You may not copy, modify, distribute, sell, lease, or sub-license any part of the Service or included software. You may not decompile, reverse engineer, or attempt to extract the source code or underlying algorithms of the Service or any software or data within it (except to the limited extent such prohibition is unenforceable under applicable law). All rights not expressly granted to you are reserved by Bower and its licensors. This license does not transfer any ownership rights in the Service or any content.

3. Service Description

OceanIR is an AI-powered geolocation analysis platform that uses computer vision and machine learning to analyze images or other geospatial inputs and generate location-related insights ("Results"). The Service may allow you to upload or input images and data, analyze and visualize geolocation information, and obtain reports or other analytical outputs. Bower makes no guarantee that the Service or any Results will meet your expectations or requirements, or that the outputs will be suitable for any particular purpose. The specific features and functionality of OceanIR are described on our website or documentation and may evolve over time as we improve the Service.

Important – Accuracy and Privacy Safeguards: You acknowledge that OceanIR's geolocation Results are intended to be approximate and not exact. In order to protect individual privacy and prevent misuse by bad actors, the Service may intentionally limit the precision or accuracy of location outputs. OceanIR is not designed for real-time or exact tracking of any person or object. All locations or identifications provided by the Service are best-effort estimates and should not be relied upon as precise or guaranteed.

Bower reserves the right to add, change, suspend, or discontinue any portion of the Service or any feature at any time, with or without notice. We may impose limits on certain features or restrict your access to parts or all of the Service without liability. We will attempt to provide advance notice of any material changes when feasible, but are not obligated to do so. You acknowledge that the Service will be updated and improved over time, and that new features or enhancements may be released. Any new features that augment or enhance the current Service (including the release of new tools or resources) will be subject to these Terms.

4. User Accounts

To access certain features or areas of the Service, you may need to create a user account. When creating an account, you agree to provide accurate, current, and complete information, and to update such information promptly if it changes. Account Security: You are responsible for maintaining the confidentiality of your account credentials (such as usernames, passwords, and API keys) and for all activities that occur under your account. You must not share your account or password with anyone else, and you agree to notify us immediately at legal@bower.site of any unauthorized access or use of your account or any other breach of security.

You are responsible for all actions taken under your account, whether or not authorized by you. Bower will not be liable for any loss or damage arising from your failure to secure your account information. We reserve the right to suspend or terminate your account (in addition to any other remedies available to us) if any registration information you provide is false, misleading, outdated, or incomplete, or if we suspect that your account is being used in violation of these Terms or any applicable law.

5. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information in connection with the Service are described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understand the Privacy Policy and you consent to the collection and use of your information as described therein. If you do not agree with our Privacy Policy, you must not use the Service.

In using OceanIR, you may provide or upload data, including images, geolocation information, and possibly personal data related to individuals or places. You represent and warrant that you have all necessary rights, permissions, and, if required by law, consents to provide such data to Bower for analysis. You further represent that submitting the data to the Service and the processing of that data by Bower will not violate any law or any third party's rights, including privacy, intellectual property, or data protection rights. We will handle any personal data you provide in accordance with our Privacy Policy and applicable laws (including U.S. federal and Florida state privacy laws). 6. Payment and Premium Access

Free and Paid Tiers: Bower may offer OceanIR in various plans or tiers, including a free/basic version and one or more paid premium versions with additional features or higher usage limits. Details of available plans, features, and pricing will be provided on our website or through the Service. By choosing to use a paid tier of the Service, you agree to pay all applicable fees and charges as described at the time of purchase or subscription.

Payment Terms: If you sign up for a premium or paid plan, you must provide a valid payment method and accurate billing information. Fees may be charged on a one-time, usage-based, or subscription basis, as specified for the chosen plan. Unless otherwise stated, all fees are in U.S. Dollars and are non-refundable (except as required by law or expressly stated in a refund policy). If you subscribe to a recurring plan (e.g., monthly or annually), you authorize Bower to automatically charge your provided payment method at the start of each billing period for the fees due, until you cancel the subscription. It is your responsibility to cancel a subscription before renewal if you do not wish to be charged for the next period. We reserve the right to cancel or suspend your access to the premium Service if your payment is late, cannot be processed, or is otherwise declined.

Changes to Fees: Bower may modify the fees and pricing for the Service or introduce new premium features with additional fees. If we do so, and you are a current subscriber, we will provide reasonable advance notice of the changes (for example, by email or through the Service). New pricing will not apply retroactively to any period for which you have already paid, but will take effect upon renewal or new purchases. If you do not agree to a fee change, you must cancel your paid plan before the new fees take effect. Continued use of the Service after the effective date of a fee change constitutes your acceptance of the new fees.

Enterprise and Customized Solutions: If your needs exceed the standard offerings (for example, if you require a custom deployment, dedicated infrastructure, specialized data integration, or significantly higher usage volumes), please contact us to discuss enterprise solutions. Interested parties may reach out to us at support@bower.site for private enterprise contracts or advanced use of the AI. Enterprise or bespoke use of OceanIR may be governed by separate negotiated terms in addition to these Terms.

7. Prohibited Uses

You may use OceanIR only for lawful purposes and in accordance with these Terms. You agree not to misuse the Service. Prohibited uses of the Service include, but are not limited to, any of the following:

  • Illegal Activities: Using the Service for any purpose that violates any applicable law or regulation, or in furtherance of any unlawful activity. You may not use OceanIR to assist in the planning or execution of crimes or other illegal acts. Any content or query that is itself illegal to possess or distribute is strictly prohibited on the Service.
  • Stalking, Harassment, or Personal Surveillance: Using the Service to stalk, spy on, harass, or harm any individual. This includes attempting to track, monitor, or identify a person without their knowledge and consent or in any manner that violates privacy rights, data protection laws, anti-stalking laws, or harassment laws. Examples: You must not use the Service to surveil a current or former romantic partner, family member, friend, or acquaintance. Geolocation data or Results obtained from OceanIR must not be used to violate anyone's rights, threaten their safety, or otherwise intrude upon their privacy.
  • Unlawful or Illicit Content: Uploading, submitting, or querying the Service with any content or data that is unlawful to possess, transfer, or use. This includes content that is illegal under applicable laws (for example, illegal surveillance footage, obscenity or exploitative images, or any data obtained by illicit means). You represent that any content you upload is lawfully obtained and that you have the right to use and submit it. Do not use OceanIR with any images or data whose use would violate any law or regulation.
  • Intellectual Property Infringement: Uploading or transmitting any content that infringes or misappropriates the intellectual property rights of others. You must not use the Service with any images, text, or data that you do not have permission or legal right to use. This includes violating patents, trademarks, trade secrets, copyrights, privacy rights or other proprietary rights of any party.
  • Interference with the Service: Engaging in any activity that disrupts, interferes with, or harms the Service or the networks and systems connected to the Service. This prohibition includes introducing viruses, malware, worms, logic bombs, or any other harmful code; launching any form of attack (such as a denial-of-service attack) on the Service; or otherwise attempting to interfere with the proper functioning of the Service or any other user's use of the Service.
  • Unauthorized Access and Hacking: Attempting to gain unauthorized access to any part of the Service, other user accounts, or any servers, systems, or networks used by Bower. You may not probe, scan, or test the vulnerability of the Service or any related system or network, or breach any security or authentication measures. Hacking or password mining the Service, or impersonating any person or entity or misrepresenting your affiliation with any person or entity while using OceanIR, is strictly forbidden.
  • Circumvention and Reverse Engineering: Circumventing, disabling, or tampering with any security or technical measures implemented by Bower to protect the Service. You must not attempt to decrypt, decompile, disassemble, or reverse engineer any software, database, or technology underlying the Service, nor create any derivative works based on the Service or its components, except to the limited extent allowed by law notwithstanding this restriction. Any attempt to discover the source code, algorithms, or trade secrets of OceanIR through unauthorized means is prohibited.
  • Scraping and Automated Data Extraction: Using any robot, spider, scraper, crawler, script, or other automated means not provided by Bower to access, query, or collect information from the Service is prohibited. You may not data-mine or harvest data from OceanIR, nor use automated systems to send requests to the Service in a manner that could overload or abuse our infrastructure. Engaging in any activity that imposes an unreasonable or disproportionately large load on the Service or Bower's networks is not allowed.
  • Commercial Exploitation: You may not commercially exploit the Service without permission. This means you cannot resell the Service or the Results, build a competing product using our Service, or use OceanIR to provide services to third parties (for example, operating an image geolocation lookup service for others) without our prior written consent. The license granted to you is for your use only. Any attempt to bypass our commercial offerings (such as using the free Service for purposes that compete with Bower's business or to avoid purchasing a higher tier) is a violation of these Terms.
  • Objectionable Content: Posting, transmitting, or using the Service with any content that is harmful, abusive, harassing, violent, defamatory, vulgar, obscene, or otherwise objectionable. You may not use the Service to create or disseminate content that promotes or incites discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group. Bower has zero tolerance for using OceanIR in connection with hate speech, extremist material, or any content that is grossly offensive or exploitative.
  • Violation of Others' Rights: Using the Service in any way that infringes or violates the rights of others. This includes violating another person's privacy or publicity rights, collecting or disclosing someone's personal information without authorization, or targeting individuals (especially minors) with invasive monitoring. You must not request or use any personal data via the Service that you are not authorized to have. For example, do not use OceanIR to attempt to locate or identify minors without proper parental consent or lawful authority.

Bower reserves the right to investigate and take appropriate action against any user who, in our sole discretion, is suspected of violating these Prohibited Uses or any other aspect of these Terms. Enforcement actions may include suspension or termination of your account, disabling access to the Service (in whole or in part), and reporting your activities to law enforcement authorities or other appropriate third parties. You understand that any attempt to engage in prohibited conduct may also subject you to legal liability (civil and/or criminal).

8. Intellectual Property

Ownership by Bower: All rights, title, and interest in and to the Service (including, but not limited to, the software, algorithms, models, databases, user interface, website design, text, graphics, logos, trademarks, and all content provided by Bower) are and will remain the exclusive property of Bower and its licensors. The Service is protected by United States and international intellectual property laws, including copyright, trademark, patent, and trade secret laws. OceanIR, Bower, and associated logos or names are trademarks or service marks of Bower Software Industries, Inc. (or its affiliates). Nothing in these Terms grants you any license or right to use Bower's name, logos, or trademarks, except as necessary for you to use the Service in accordance with these Terms. Any unauthorized use of Bower's branding is strictly prohibited.

Your Content and Data: You retain any ownership rights you hold in the images, data, and other content you upload or submit to the Service ("User Content"). By submitting or uploading User Content to OceanIR, you hereby grant Bower a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, transfer, display, perform, reproduce (e.g., for creating cached copies or performing analysis), and create derivative works of your User Content, solely for the purpose of operating and improving the Service or as otherwise described in our Privacy Policy. This license enables us, for example, to process your images through our algorithms and generate Results, to display those Results back to you, and to use your input to enhance our models and services. We will not use or share your User Content outside of providing the Service to you, except as permitted by these Terms, our Privacy Policy, or as required by law. You represent and warrant that you have all necessary rights to provide the User Content to the Service and to grant the above license, and that our use of the content in accordance with these Terms will not infringe or violate any third-party rights.

Feedback: If you send Bower any suggestions, ideas, enhancement requests, recommendations, or other feedback regarding the Service ("Feedback"), you acknowledge that such Feedback is provided voluntarily and that Bower may use, implement, and profit from this Feedback without any obligation or compensation to you. Accordingly, you hereby grant Bower a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate any Feedback you provide in any manner Bower deems appropriate. Bower is not required to acknowledge or act upon Feedback, but we value user input to improve our products.

No Implied Rights: Except for the limited license granted to you in Section 2 (Use License) and your rights in your own User Content, nothing in these Terms shall be construed as transferring or granting any right, title, or interest in the Service or any Bower intellectual property to you. Bower and its licensors retain all right, title, and interest in and to OceanIR and all related IP. You agree not to remove, obscure, or alter any copyright, trademark, or other proprietary rights notices on the Service or on any content you receive via the Service.

9. User Responsibilities

When using OceanIR, you agree to take responsibility for how you interpret and act upon the information the AI provides. In particular, you understand and agree to the following:

  • Interpretation of Results: You will treat all geolocation outputs and analytical results from the Service as approximations and informational only, not as absolute truth. OceanIR's AI-generated results may be incomplete, outdated, or inaccurate. They are meant to provide clues or insights, but not definitive answers about location.
  • No Legal or Forensic Use: You acknowledge that OceanIR's outputs are not forensic evidence and should not be used or represented as conclusive proof in any legal, law enforcement, or investigative context without independent verification. You agree not to present or rely on the Service's results as if they are certified, exact, or legally admissible data. For example, you will not use an OceanIR result as the sole basis to accuse someone of being in a certain location or to make important decisions impacting others' rights or safety.
  • Independent Verification and Discretion: You are responsible for evaluating the accuracy and relevance of any Results for your purposes. Use common sense and discretion when acting on OceanIR's outputs. If you intend to use the information for any consequential purpose (such as locating a missing person, conducting research, or informing business or personal decisions), you should corroborate the AI's results with other sources or methods. You should not make critical decisions solely based on OceanIR without considering context and seeking professional or expert advice where appropriate. Ultimately, you assume all risk for any actions you take based on the information provided by the Service.
  • Compliance and Ethical Use: You agree to use the Service and interpret its results in a manner that is ethical and compliant with all applicable laws. You will respect the spirit of these Terms by not attempting to misuse information even if technically obtained. If a certain use of the results seems likely to violate someone's privacy, cause harm, or fall into a prohibited category, you will refrain from that use. You understand that misuse of the Service's information is strictly your responsibility and can lead to consequences as outlined in these Terms (including account termination or legal action).

By adhering to these User Responsibilities, you help ensure that OceanIR's powerful capabilities are used safely, lawfully, and for positive purposes. If you cannot or do not agree to uphold these responsibilities, you must not use the Service.

10. Disclaimers of Warranties

The Service (including all content, information, analyses, and Results provided or generated by the Service) is provided on an "AS IS" and "AS AVAILABLE" basis. Bower and its affiliates, officers, employees, agents, partners, licensors, and suppliers (collectively, the "Bower Parties") disclaim all warranties and representations of any kind, whether express, implied, or statutory, regarding the Service. This includes, without limitation, any implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, and any warranties that might arise from course of dealing or performance.

Without limiting the above, Bower makes no warranty that the Service will operate uninterrupted or error-free, that it will be secure or free of viruses or other harmful components, or that any defects or errors will be corrected. We specifically do not warrant or guarantee the accuracy, completeness, timeliness, or reliability of any information or Results obtained through OceanIR. You acknowledge that any reliance on the Service or its outputs is at your own risk. OceanIR's geolocation suggestions or identifications might be incorrect or only partially correct; they might point to a general area rather than an exact spot, or they may fail to identify a location at all. These uncertainties are intentional features and inherent limitations of the AI system aimed at preserving safety and privacy, as noted earlier.

No advice or information (whether oral or written) obtained by you from Bower, or through the Service, shall create any warranty not expressly stated in these Terms. You understand that any data, analysis, or recommendation provided by the AI is not a substitute for your own judgment or professional advice.

Some jurisdictions do not allow the exclusion of certain warranties. To the extent that any such exclusion is not permitted by law, those warranties are not excluded but are limited to the minimum duration and scope allowed by law.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Bower or the Bower Parties be liable to you for any indirect, incidental, special, consequential, punitive, or exemplary damages whatsoever, arising out of or related to your use of (or inability to use) the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, and even if Bower has been advised of the possibility of such damages. This limitation includes, for example, any loss of profits or revenue, loss of data, business interruption, computer damage, or other commercial or personal losses arising from or relating to your use of OceanIR or reliance on its outputs.

In addition, and without limiting the foregoing, Bower and the Bower Parties will not be responsible or liable for any harm, injury, or damages resulting from your misuse of the Service or use of the Service in violation of these Terms. You are solely responsible for any consequences (legal, financial, or otherwise) of how you choose to utilize the information or tools provided by OceanIR. Bower cannot and does not assume any liability for actions you take that breach the Prohibited Uses or other provisions of these Terms, or for harms resulting from unauthorized or unethical use of the Service by you or any third party.

To the extent the law permits, Bower's total cumulative liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total amount (if any) you paid to Bower for the use of the Service in the twelve (12) months immediately preceding the event giving rise to the liability, or (b) USD $100.00. If you have not paid Bower any amount in that period, the cap under (b) applies. This limitation is cumulative and not per-incident (multiple claims will not increase the cap).

You acknowledge that Bower is offering the Service and setting the applicable fees (including offering free access where applicable) in reliance on the warranty disclaimers and liability limitations set forth in these Terms. These provisions form an essential basis of the bargain between you and us. You agree that the limitations of liability in this Section will apply even if any limited remedy fails of its essential purpose.

Because some jurisdictions do not allow the exclusion or limitation of certain damages, some of the above limitations may not apply to you. In those jurisdictions, Bower's liability will be limited to the maximum extent permitted by law.

You agree that Bower's affiliates, licensors, and suppliers (and their respective officers, directors, employees, and agents) are intended third-party beneficiaries of the disclaimers and limitations of liability in this section. These parties have the right to enforce those provisions as if they were parties to these Terms.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bower, its parent, subsidiaries, and affiliates, and each of their respective officers, directors, employees, agents, partners, licensors, and suppliers (the "Indemnified Parties"), from and against any and all claims, liabilities, damages, losses, judgments, awards, costs or expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

  • Your Use or Misuse of the Service or Results: This includes any use of OceanIR or its outputs that is not in accordance with these Terms, or any actions you take (or fail to take) based on information obtained through the Service. (For example, if you misuse the Service to invade someone's privacy and they sue Bower, you agree to indemnify Bower for that claim.)
  • Your Violation of These Terms or of Law: Any breach by you of any provision of these Terms, or any violation of applicable law or regulation in connection with your use of the Service.
  • Infringement of Rights: Any claim that your User Content, or your use of the Service, infringes, misappropriates, or violates the intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party.
  • Your Submitted Data: Any claim related to data or content you submit to the Service, including any allegation that you lacked proper rights or consents to use the data (for instance, that you uploaded an image without the photographer's permission or without required privacy consents).

Bower reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. If we do so, you agree to cooperate with our defense of that claim and you will not settle any such claim without Bower's prior written consent. You acknowledge that the Indemnified Parties have no obligation to you in connection with any such claim, and you agree to reimburse any of the Indemnified Parties for all losses, damages, costs, and expenses incurred as a result of any such claim, to the extent such reimbursement is not prohibited by law. Your indemnification obligations under this section will survive termination or expiration of these Terms and your use of the Service.

13. Termination

These Terms remain in effect until terminated. You may terminate your agreement with these Terms at any time by discontinuing all use of the Service and closing any account you have with OceanIR. However, all provisions of these Terms which by their nature should survive termination (such as intellectual property rights, disclaimers, indemnities, and limitation of liability) will continue in effect after you stop using the Service.

Bower may suspend or terminate your access to the Service (or terminate these Terms with respect to you) at any time, with or without notice, and for any reason or no reason. Without limiting the foregoing, we may terminate or suspend your account or access if: (a) we believe you have violated these Terms or any applicable law; (b) you fail to pay any fees when due (if applicable); (c) we experience unexpected technical or security issues or problems with the Service; (d) we decide, in our sole discretion, to discontinue the Service or a portion of it (such as if it is no longer viable to operate); or (e) we reasonably suspect that you have engaged in fraud, abuse, or conduct that could cause harm to Bower, the Service, or any third party.

We shall not be liable to you or any third party for any termination or suspension of your access to the Service. If your account or this agreement is terminated for any reason: (i) any rights and licenses granted to you under these Terms will end immediately; (ii) you must cease all use of the Service and destroy any confidential or proprietary information you have obtained from the Service (except for your own User Content); and (iii) if you had any outstanding payment obligations, they will become due immediately. Bower may delete or disable access to your User Content and data upon termination of your account. However, you acknowledge that Bower may retain certain data as required by law or for legitimate business purposes consistent with our Privacy Policy (for example, server backup copies or logs), and that Bower is not obligated to return or destroy data that remains in archives or backups.

14. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or related to these Terms or the Service will be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of laws principles. To the extent U.S. federal law applies, it will govern alongside Florida law. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Jurisdiction and Venue: Subject to any arbitration provisions (if a separate agreement to arbitrate exists between you and Bower), you agree that any claim or dispute that must be resolved in court will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, USA. You consent to the personal jurisdiction of such courts and waive any objections to the convenience of this forum (you will not argue that these courts are an inconvenient or improper venue).

If you are accessing the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. You agree that, by using the Service, you are subjecting yourself to the laws of the United States and the State of Florida, and you explicitly waive any application of the laws of any other jurisdiction to the interpretation of these Terms. Nothing in this section limits either party's right to seek injunctive or equitable relief in any competent court to prevent actual or threatened infringement or other violation of intellectual property rights, confidentiality obligations, or data security obligations.

15. Changes to Terms

Bower reserves the right to modify or update these Terms at any time. If we make material changes to the Terms, we will make reasonable efforts to notify you by posting the updated Terms on our website and/or through other communications (such as email, if you have provided one associated with your account). The "Effective Date" at the top of this page indicates when the Terms were last revised. Your continued use of the Service after revised Terms have been posted or communicated to you constitutes your acceptance of those changes.

It is your responsibility to review these Terms periodically for any updates. If you do not agree to a change in the Terms, you should stop using the Service and (if applicable) cancel any accounts or subscriptions. No modification or amendment to these Terms by you will be binding on Bower unless expressly agreed in writing by an authorized representative of Bower.

16. Entire Agreement

Any waiver of a provision of these Terms by Bower must be made in writing. Bower's failure to insist on or enforce strict performance of any part of these Terms is not a waiver of any of our rights. Similarly, a waiver of any default shall not constitute a waiver of any subsequent default.

18. Age Requirement

The Service is not intended for use by anyone under the age of 13. By using OceanIR, you represent and warrant that you are either (i) at least 18 years old and capable of entering into a binding contract, or (ii) at least 13 years old and using the Service with the consent and under the supervision of a parent or legal guardian who has agreed to these Terms on your behalf. If you are using the Service as a minor (age 13–17), your parent or guardian is responsible for your compliance with these Terms and your actions on the Service.

Bower does not knowingly collect personal information from children under 13. 19. Beta & Experimental Features

From time to time, Bower may offer certain features of OceanIR on a beta or experimental basis ("Beta Features") for users to test and provide feedback. Beta Features will be identified as beta, pilot, early access, or experimental within the Service. Your use of any Beta Features is voluntary and is permitted only if you agree to the following additional terms:

  • "As Is" for Beta: Beta Features are provided "AS IS" and "AS AVAILABLE", without any warranty whatsoever, and may be unstable or contain errors. Beta Features might not be as reliable or accurate as the main Service and could be changed, suspended, or removed by Bower at any time. We make no promises that Beta Features will work correctly, meet your needs, or be continued in the future.
  • Potential Changes: You acknowledge that Beta Features are in active development. They may change significantly before any full release (or they may never be released commercially). Bower reserves the right to modify or discontinue Beta Features at any time without notice and without liability.
